To be effective under 17 U.S.C. § 512(c)(3), your written notification must include substantially the following information:

Required Elements of a Valid DMCA Notice

  1. Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
  3. Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, including the exact URL(s) on dopmah.in.
  4. Contact Information: Information reasonably sufficient to permit Dopmah to contact you, such as an address, telephone number, and, if available, an electronic mail address.
  5. Good Faith Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy Statement Under Penalty of Perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

5. DMCA Counter-Notification Procedure

If material that you posted on Dopmah has been removed or access to it disabled as a result of a DMCA takedown notice, and you believe that the material was removed or disabled by mistake or misidentification, you may file a written Counter-Notification with our Designated Agent.

Under 17 U.S.C. § 512(g)(3), a valid Counter-Notification must contain:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (exact URL).
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located (or if outside the US, for any judicial district in which Dopmah may be found), and that you will accept service of process from the person who provided the original DMCA notification.

Upon receipt of a valid Counter-Notification, Dopmah will promptly forward a copy to the original complaining party. If the original copyright owner does not file a court action seeking a judicial order against the content provider within 10 to 14 business days, we may restore the removed material at our discretion.

6. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Dopmah maintains a strict policy of terminating, in appropriate circumstances and at our sole discretion, users, contributors, or account holders who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the website or terminate user accounts of any persons who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

7. Warning Against False Allegations (Section 512(f) Penalties)

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including legal costs and attorneys' fees incurred by the alleged infringer, by any copyright owner or copyright owner's authorized licensee, or by Dopmah.
